Rental Agreement

This Rental Agreement (the "Agreement") is entered into as of the date of hire and rental (the "Effective Date") by and between eBike Pedal Rentals (ABN: 43 512 302 716) ("we", "us" or "our") and the customer or customers that are the named cyclist or cyclists of an ebike during the hire and rental period of an ebike ("Customer" or "you").

1. Definitions In This Agreement

The following definitions apply: 


(a) "Customer" includes legal guardians of young people aged between 14 and 18 years who are riding our ebikes during the hire and rental period. Legal guardians accept the obligations and responsibilities of these terms and conditions on behalf of young people. 


(b) "Rental Period" means the period of time for which the Customer has agreed to rent an ebike from us. 


(c) "ebike" means an electric bicycle provided by us to the Customer for use during the Rental Period.

2. Agreement Acceptance

When you hire and rent an ebike from us and continue to use the ebike, you agree that you will be bound by these terms and conditions as part of the rental agreement.

3. Risk Warning

Riding an ebike can be dangerous and comes with risks to you and others and may potentially result in personal injury, death, property damage or economic loss. By riding an ebike you are taken to have accepted these risks and you agree to do so at your own risk. You assume full responsibility for all related risks, dangers and hazards. 

4. Age Restrictions

Our ebikes must not be operated by any person under the age of 14 years old under any circumstances.

5. Our Limited Liability

To the extent permitted by law, we will not be liable for any loss, damage or injury or consequential loss or damage arising from your use of our ebikes, or your breach of the Terms and Conditions set out in this Rental Agreement. Nothing in these Terms and Conditions excludes liability for statutory guarantees available to you under the Australian Consumer Law. 

6. Your Liability

You are responsible for any third party loss, damage or injury arising from your use of the ebike and you must indemnify us for any claim made against us for that damage or loss. 

7. Your Obligations and Responsibilities

As a Customer, it is important to understand and adhere to your obligations and responsibilities to ensure a safe and enjoyable experience.


a) Eligibility:

  • Age: Confirm your age and, or that you are the legal guardian of a young person between the ages of 14 and 18 years providing supervision throughout the rental period.
  • Health and fitness: Ensure that you are in good health and physically fit, without any medical conditions that would affect your ability to safely operate the ebike, without causing harm to yourself, others, property, or the environment.
  • Bicycle operation knowledge: Possess the ability to operate a multispeed bicycle and be familiar with road rules and special rules that apply to bicycle riders.
  • Hazard awareness: Be aware of potential hazards when riding a bicycle and know the appropriate actions for responding to such hazards.
  • Punctuality: Arrive 20 minutes prior to your booking to complete the customer onboarding process.
  • Exclusive use: Do not allow anyone not named on the rental agreement to use the ebike during the rental period; it is solely for your use or that of other named parties listed on the agreement.


b) Onboarding:

  • Complete the mandatory onboarding process which takes about 10 minutes, prior to taking the ebike for the specified rental period.
  • Arrive 10 minutes before the booked rental period to avoid disappointment and ensure the full rental period is available for riding the ebike.
  • The onboarding process includes payment completion, providing photo identification, security deposit, fitting of helmets and vests, and receiving briefings on the ebike's operation and health and safety.


c) Responsible Behavior:

  • Treat our staff with patience and politeness, even when situations don't go as planned due to circumstances beyond our control.
  • Rudeness, abuse, or irresponsible behavior, such as intoxication and carelessness, will not be tolerated and may result in booking cancellations at the staff's discretion.


d) Photo Identification:

  • Provide valid photo identification, such as an Australian photo driver's license, Australian or overseas passport, Australian photo proof of age card, or Australian photo seniors card.


e) Security Deposit:

  • Pay a security deposit for each ebike rented, which will be refunded when the bike is returned in working order after a check-over.


f) Late Returns:

  • Return the ebike by the specified return time to avoid a mandatory $60 late fee. A 10-minute grace period is provided, but there are no exceptions beyond this grace period.


g) Extending the Rental Period:

  • Rental period extensions are possible if the ebike is available and not already booked by another Customer. Notify us as early as possible to accommodate your request.


h) Road Side Assistance:

  • If an ebike or Customer requires assistance during the rental period, a $60 road side assistance fee will be charged per ebike, payable by the customer.


i) Damage:

  • Any damage to an ebike and, or supplied accessories will be paid for by the Customer. It is important that the staff member making the rental fills out the check out a form accurately so there is no disputing the ebikes’ condition at the start of the rental period. Any damage to the ebikes caused by the Customer (i.e. was not evident on the checkout form) is due and payable on the day by the Customer, whose credit card will be charged by ebike Pedal Rentals. The fees are variable depending on the severity of the damage. 
  • The following is a guideline of typical fees that you could expect pay when an item is damaged. 

                - Mirrors $15 each 

                - Flags $15 each 

                - Helmets $80 each 

                - Vests $25 each 

                - Tyres $60 each 

                - Batteries $850 each 

  • Our ebikes must not be taken onto the beaches under any circumstances. Sand can and will get into the components of the ebike, especially the chain and derailleur. Sand is hard to get off a bicycle. The fee for a full clean and service on the chain and derailleur of the ebike is $60. 


j) Theft:

  • Lock the ebike when not in use, as there is no insurance for theft. Customers are responsible for the safe return of the ebike during the rental period.


k) Cleaning:

  • Avoid riding over dog poo to prevent a $30 cleaning fee.


l) Cancellation and Refund Policy:

  • For cancellations made more than 48 hours before the booking date, a full refund will be issued.
  • For cancellations made between 24 and 48 hours before the booking date, a 50% refund will be issued.
  • No refunds will be given for cancellations made less than 24 hours before the booking date, or for no-shows.
  • Refunds may take up to 5 business days to process and will be issued using the same payment method used during booking.
  • In case of extreme weather conditions, we may cancel the booking for safety reasons and provide a full refund or reschedule the booking for another date at no additional cost.


m) Personal Insurance:

  • Ensure that you have adequate personal insurance coverage for any injury, accident, or loss that may occur during the rental period. We do not provide personal insurance coverage for Customers.


n) Helmet and Safety Vest:

  • Always wear the provided helmet and safety vest when riding the ebike to ensure your safety and visibility to others on the cycleway and road. Failure to wear these items may result in fines or penalties according to local laws.


o) Compliance with Laws and Regulations:

  • Follow all local, state, and federal laws and regulations governing bicycle usage, including traffic laws, bicycle-specific laws, and any posted signage or rules. Failure to do so may result in fines or penalties, for which you will be solely responsible.


By understanding and adhering to these obligations and responsibilities, you help ensure a safe and enjoyable experience for yourself and other Customers, while also protecting our interests.  

8. Hazards

Cycling is an active sport requiring the cyclist to be spatially aware at all times of their environment, and potential hazards. 


The Customer is expected to be scanning for hazards continuously while cycling during the rental period. 


Set out in this section are some common hazards that you are likely to see on your bicycle ride. This is not an exhaustive list. 

  • People that are not looking for bicycles when entering and exiting the cycleway, crossing the cycleway, or changing direction. There are many situations when people are not looking. 
  • Wildlife such as birds and lizards obstructing your pathway. 
  • Distractions such as dolphins, or scenic moments. 
  • People with a vision impairment, who may also be unsteady on their feet. 
  • People with a hearing impairment, this includes people with headphones or ear plugs. They may not hear the bicycle bell, and may also be unsteady on their feet.
  • People in wheelchairs or using walking aids. 
  • Mothers and fathers with prams which take up a large part of the path.
  • Dogs on and off lead running out in front of you. 
  • Children not looking and running out in front of you. 
  • Elderly can be unsteady on their feet, ensure you buffer so as not to surprise the elderly person and cause them to fall. 
  • Other cyclists and electrical mobility technology. 
  • Sand on the cycleway. Braking hard on a sandy patch can cause the bike to slide and you may fall. 
  • Blind corners and hill crests. Sound the bicycle bell and slow down. 


In all situations while cycling the Customer is expected to observe and practice the following safe cycling behaviours in response to all potential hazards. 

  • Scan ahead for hazards continuously. Keep your head up and always look forward and from side to side. 
  • Buffer which means allowing plenty of space between you and any hazards. If you cannot buffer then slow down or stop until you can cycle safely. 
  • Be aware of what is behind you, especially when passing pedestrians and other obstructions in your pathway. 
  • Slow down or come to a complete stop. 
  • Sound the bicycle bell before passing pedestrians. This is common practice and pedestrians appreciate knowing that there is a cyclist approaching. 
  • Keep the front and rear lights on while cycling. 
  • Observe all road rules and special laws in New South Wales for riding a bicycle.  

9. Weather Clause

In the event of adverse weather conditions, such as rain or thunderstorms, that may impact the safety and enjoyment of renting an ebike, the following policies will apply:


a) Safety First:

  • The safety of our customers is our top priority. If, in the sole discretion of eBike Pedal Rentals weather conditions are deemed unsafe for riding an ebike, we reserve the right to cancel or modify reservations for the safety of our customers. 


b) Cancellation due to Inclement Weather:

  •  If your ebike reservation is cancelled by eBike Pedal Rentals due to adverse weather conditions, you will be eligible for a full refund for the affected rental period. 


c) Refund Policy:

  • Refunds will only be issued for the specific days or hours affected by adverse weather conditions. No refunds will be granted for the remainder of the rental period unaffected by weather.


d) Notification of Cancellation:

  • eBike Pedal Rentals will make every effort to notify customers in advance if adverse weather conditions are anticipated, leading to the cancellation of reservations. However, we reserve the right to make last-minute cancellations for safety reasons.


e) Rebooking Option:

  • In the event of a weather-related cancellation, customers will have the option to reschedule their reservation for alternative dates, subject to availability. eBike Pedal Rentals will work with customers to accommodate their rescheduling needs.

10. Entire Agreement

This Rental Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, negotiations and discussions, whether oral or written, between the parties. 


eBike Pedal Rentals reserves the right to update, modify, or amend the terms and conditions of this agreement at any time. Notice of such changes will be provided to the Customer through written notification, and the revised terms shall become effective on the specified date in the notice. By continuing to use eBike Pedal Rentals after the effective date of the changes, the Customer agrees to be bound by the updated terms and conditions.


This Rental Agreement shall be governed by and construed in accordance with the laws of New South Wales, Australia.

By renting an ebike from us, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Rental Agreement.
